Rules of the online store
§1 General Provisions
This regulation governs the rules for using the Online Store operated at www.mindenglish.co. The online store, operating at www.mindenglish.co (hereinafter referred to as "Mind your English"), is run by Skillhouse - Weronika Reszela, 6191972845, 368892938, further referred to as "Weronika Reszela". The contact details of the entrepreneur enabling the Buyer to contact the Seller are as follows: postal address: Manganowa 6/2, 53-441 Wrocław, phone number and/or fax: tel .: +48600598880, email address: weronika.reszela@gmail.com or weronika@skillhouse.io. The regulations of the Mind your English online store are continuously placed on the website www.mindenglish.co in a way that allows Customers to obtain, reproduce, and preserve its content. The regulations are also made available to Customers before concluding the contract.
§ 2 Definitions
The terms used in this regulation mean: Consumer - a natural person within the meaning of art. 221 of the Civil Code, Entrepreneur with consumer rights - a natural person entering into an agreement directly related to their business activity, when the content of this agreement indicates that it does not have a professional character for this person, resulting in particular from the subject matter of the business activity carried out by them, made available on the basis of the provisions on the Central Register and Information on Economic Activity, Entrepreneur - means a natural person, a legal person or an organizational unit not being a legal person, which the law grants legal capacity, conducting business activity or professional activity in its own name and performing a legal act directly related to its business or professional activity,
Service Provider/Seller - Skillhouse- Weronika Reszela, Wiosny Ludów 23/17, 63-600 Kępno, NIP 6191972845, REGON 368892938: Online store - an online store operated at www.mindenglish.co by the Civil Code - the Act of April 23, 1964 (Journal of Laws 2020, item 1740), Goods and Services - all services provided and goods subject to a sales agreement between the seller and the buyer, Regulations - these regulations for the provision of electronic services within the meaning of art. 8 of the Act on the provision of electronic services of July 18, 2002 (Journal of Laws 2020, item 344), Client/Buyer - a natural person, a legal person or an organizational unit not being a legal person, to whom specific legal provisions grant legal capacity, who places or plans to place an Order within the Online Store using an electronic means of communication, including also a Consumer, Entrepreneur with consumer rights and Entrepreneur, Order - the Customer's declaration of intent in which the Customer accepts the Seller's sales offer, which includes in particular the price, type, quantity of Goods or Services within the sales agreement through the online store.
Consumer Rights Act - Act of May 30, 2014 on consumer rights (Journal of Laws 2020, item 287).
§ 3 Rules for using the online store
The prices of all goods and services offered by the Store are gross prices (including VAT) and are expressed in Polish zlotys. Exceptions to the Polish currency rule are clearly marked. The prices listed on the Mind your English store website, as well as the descriptions of goods and services, are only commercial information, not an offer within the meaning of the Civil Code. They gain a binding character - for the purpose of concluding a specific agreement - only upon confirmation of acceptance of the order for execution by the Seller.
The Seller may use discount codes in the Mind your English online store entitling to purchase goods/services with a discount specified on the coupon. Discount codes are not exchangeable for cash equivalents. Acceptance of these Regulations is necessary to place an order in the Mind your English online store. To successfully place an order in the Mind your English online store, it is necessary to have a device with Internet access enabling browsing of websites, as well as a keyboard or other device enabling correct completion of electronic forms. It is recommended to use the latest versions of web browsers: Firefox, Chrome, Internet Explorer, Microsoft Edge, Opera, Safari for OS X, etc. The Online Store's website uses Responsive Web Design (RWD) technology, which adjusts the content of the page to the device on which it is displayed. The Store's website is prepared to be displayed on both desktop computers and mobile devices. The Mind your English online store website has an SSL certificate - a secure communication encryption protocol.
§ 4 Conditions of concluding a sales agreement
Orders in the Mind your English online store can be placed by completing the appropriate forms available on the store's pages. When placing an order, the Customer is obliged to provide correct personal data: first and last name, address, email address, and mobile phone number. Upon receipt of the order, the Seller confirms its receipt and simultaneously informs about the acceptance of the Order for execution. Confirmation of the order takes place by sending the Customer an appropriate email message to the address provided in the order form. From the moment of confirmation of acceptance of the order for execution by the Seller, the agreement is considered concluded. Providing and storing the content of the sales agreement is done by providing this Regulation on the Online Store website, sending relevant information to the Customer's email address provided when placing the order, as mentioned in §4 point 4.2. Placing orders in the Mind your English online store is possible 24 hours a day, every day of the year.
§ 5 Payment method and payment deadline
In the Mind your English store, there is the possibility of payment in one of the following ways: bank transfer to the Seller's bank account, through the payment services of external providers. If the Customer chooses to pay by bank transfer, after placing the order, the Customer sends an email requesting the bank account number to which the appropriate amount should be transferred. Upon receipt of the payment in the bank account of the Mind your English store, the order is transferred for execution. The Mind your English online store allows payment via the following external electronic payment services: -Stripe -Paypal -Przelewy24 The Customer is obliged to make the payment using one of the above-mentioned methods within 7 calendar days from the date of conclusion of the sales agreement.
§ 6 Delivery
Ordered services are delivered. The delivery time of the service is agreed upon with the service recipient(s) in the case of group courses. The Seller will make every effort to ensure that the service is provided within the time agreed by the parties. In case of inability to deliver the goods within the specified time, the Buyer will be promptly informed about it.
§ 7 Withdrawal from the contract
A Buyer who is a Consumer or an Entrepreneur with consumer rights, who has concluded a distance or off-premises contract, after making payment, does not have the right to withdraw from the concluded sales agreement for goods and services, thus the seller declares that the right to withdraw does not apply to agreements covered by art. 38 of the act of 30.5.2014 - on consumer rights, By entering into an agreement, the Consumer or Entrepreneur with consumer rights confirms that they have read the content of these regulations.
§8 Complaints
The basis and scope of the Seller's liability to the Customer for non
conformity of the Product with the Agreement are determined by generally applicable laws and the provisions of this Regulation. In the event of exercising the right referred to in the preceding point, the Buyer should inform the Seller by submitting a complaint electronically to the Seller's email address weronika.reszela@gmail.com or weronika@skillhouse.io. The Seller undertakes to respond to such a complaint within 14 days.
Detailed information regarding the possibility for the Customer who is a Consumer to use out-of-court methods of complaint handling and redress, as well as the rules for accessing these procedures, are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodship Inspectorates of Trade Inspection, and at the following internet addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php; http://www.uokik.gov.pl/wazne_adresy.php.
The Customer who is a Consumer has, in particular (but not exclusively), the following exemplary options for using out-of-court methods of complaint handling and redress: The Customer is entitled to address a permanent consumer arbitration court, referred to in art. 37 of the Act of December 15, 2000 on Trade Inspection (consolidated text: Journal of Laws of 2019, item 1668, as amended), with a request to settle a dispute arising from the concluded Sales Agreement. The regulations of the organization and operation of permanent consumer arbitration courts are determined by the regulation of the Minister of Justice of July 6, 2017, on determining the regulations for the organization and operation of permanent consumer arbitration courts at voivodship trade inspectorates (Journal of Laws of 2017, item 1356). The Customer is entitled to address the Voivodship Inspector of Trade Inspection, in accordance with art. 36 of the Act of December 15, 2000 on Trade Inspection (consolidated text: Journal of Laws of 2019, item 1668, as amended), with a request for out-of-court resolution of a dispute between the Customer and the Seller. Information on the principles and procedure of mediation conducted by the Voivodship Inspectorate of Trade Inspection is available at the offices and on the websites of individual Voivodship Inspectorates of Trade Inspection. The Customer can submit a complaint through the ODR internet platform: http://ec.europa.eu/consumers/odr/. The ODR platform also serves as a source of information about forms of out-of-court dispute resolution that may arise between entrepreneurs and Consumers.
§ 10 Personal data
The data controller is the Seller. The principles of personal data protection are set out in the Privacy Policy of the Mind your English online store, available on the website www.mindenglish.co.
§ 11 Final Provisions
The Seller reserves the right to make changes to this Regulation for important reasons. All changes to the Regulation come into force at the appropriate time indicated by the Seller, but not less than 7 days. The amended Regulation binds the Buyer/Customer if the requirements specified in art. 384 and 384[1] of the Civil Code have been met, i.e., if the Buyer was properly notified of the changes and did not terminate the agreement within 14 calendar days from the date of notification. In accordance with art. 8 sec. 3 point 2 lit. b of the Act of July 18, 2002 on the provision of electronic services, a person using the website of the ABC online store is obliged not to place any unlawful content on this website. Matters not regulated by this regulation shall be governed by the relevant provisions of the Civil Code and the Act of May 30, 2014, on consumer rights. This Regulation is available at www.mindenglish.co. Agreements with the Seller are concluded automatically at the time of purchase through the website in accordance with the regulations in Polish. The Regulation enters into force on December 1, 2022.
